What happened

Background
On July 9, 2024, the court granted the City of Los Altos’ motion for sanctions under Rule 11 against Satish Ramachandran and imposed a $10,000 penalty payable to the court. The court then allowed Ramachandran to submit a statement, declaration, and evidence concerning his claimed inability to pay.
After reviewing his initial submission, the court found that Ramachandran had adequately shown limited income but had not provided similarly detailed evidence about his assets, particularly his equity in real estate. The court’s August 6 order required him either to pay the penalty or to submit additional evidence concerning his ability to pay in light of his real-estate interests.
Evidence About the Properties
Ramachandran’s later submission satisfied the court that he did not own one of the two properties identified earlier: 820 Laverne Way, Los Altos, California. He acknowledged that he owned an interest in the second property, 889 Santa Rita Avenue in Los Altos, which he said he purchased with Sudha Iyer for $435,000 in 1993.
The court had previously noted that Zillow estimated the current market value of the Santa Rita Avenue property at more than $3.3 million. Ramachandran submitted evidence concerning that property, including a report dated February 17, 2020, prepared by a person he described as an expert in other litigation. The opinion also noted that Ramachandran had not submitted a curriculum vitae or other evidence about that person’s qualifications.
Ruling
The court stated that Ramachandran bore the burden of producing evidence showing that he could not pay the monetary sanction. It found that he had not carried that burden, even giving full credit to his evidence and despite having several opportunities to make the required showing.
The court ordered Ramachandran to pay the $10,000 penalty to the court by September 23, 2024. Payment could be made through the Clerk’s Office by check, money order, or credit card, or online through Pay.gov. Judge Susan Van Keulen signed the order as a United States Magistrate Judge.
