What happened
In Kate Spade New York LLC, et al. v. Vinci Brands LLC, et al., ACS Group Acquisitions LLC asked to file redacted counterclaims publicly and the unredacted version under seal.
ACS said the counterclaims included information that Kate Spade LLC, Coach Services, Inc., or Case-Mate, Inc. had designated confidential under a protective order. ACS did not itself consider the information confidential but sought provisional sealing while Kate Spade and Case-Mate had an opportunity to request sealing.
Judge Valerie Figueredo granted the requested provisional seal. She directed the Clerk to keep the viewing restrictions on ECF No. 309 until July 8, 2024, and directed that the motion at ECF No. 308 be terminated.

Background
ACS Group Acquisitions LLC asked the court to allow its answer with counterclaims to be filed publicly in redacted form while the unredacted counterclaims were filed under seal. ACS relied on a protective order entered on February 7, 2024. It said that some allegations were based on documents and testimony designated confidential by Coach Services, Inc. and Kate Spade LLC, or by Case-Mate, Inc. ACS stated that it did not consider the information confidential but made the request to comply with the protective order.
Request
ACS asked for provisional sealing until Kate Spade and Case-Mate had an opportunity to move to seal the material. The request stated that counsel of record should have access to the unredacted counterclaims.
Ruling
Judge Valerie Figueredo granted the provisional seal requested in the letter motion. The Clerk was directed to maintain the viewing restrictions on ECF No. 309 until July 8, 2024. The Clerk was also directed to terminate the motion at ECF No. 308. The order did not decide whether the information ultimately should remain sealed after the affected parties had an opportunity to seek sealing.
