In AETN Television Networks v. Big Fish Entertainment, Judge Failla granted defendants’ request to replace a publicly filed, incompletely redacted deposition exhibit.
The ruling affected the defendants’ publicly filed deposition exhibit, the court’s docket, and the parties to the case because Exhibit 41 was to be removed and replaced with a corrected version.
What happened
AETN Television Networks, LLC v. Big Fish Entertainment, LLC involved defendants’ request concerning a deposition transcript filed as Exhibit 41 in support of their summary-judgment motion. The defendants said the public version did not include all redactions required to protect business information designated confidential under the case’s protective order.
The defendants asked the court to remove the original exhibit from the public docket and allow a corrected version with the additional redactions. They said the testimony at issue was not cited in their summary-judgment filings and had minimal relevance to that motion.
Judge Katherine Polk Failla granted the application. The court ordered that the original filing be stricken from the public docket and replaced, and directed the Clerk of Court to terminate the pending motion at docket entry 146.

Background
Defendants filed a letter requesting relief concerning Exhibit 41 to the declaration of Doran Satanove. The exhibit was a deposition transcript that had been publicly filed in redacted form. Defendants explained that they had discovered that their proposed redactions were incomplete because the public version included testimony they had designated confidential under the case’s protective order.
Defendants asserted that the testimony contained sensitive business information whose disclosure could harm Big Fish Entertainment LLC. They also stated that the testimony was not cited in their summary-judgment statement or brief and therefore had minimal relevance to the summary-judgment motion. Defendants requested that the court direct the Clerk to remove Exhibit 41, docket entry 145-41, from the public docket and grant permission to file a corrected version with the complete set of proposed redactions.
Ruling
The court granted the application. It stated that the original filed document was stricken from the public docket and that the court would replace Exhibit 41. The court also directed the Clerk of Court to terminate the pending motion at docket entry 146. The order was dated October 17, 2024, and signed by Judge Katherine Polk Failla.
