In Kate Spade LLC v. Vinci Brands LLC, Judge Figueredo ordered parties to justify or lose provisional seals and unsealed other documents.
The parties and other interested parties seeking to keep the identified documents sealed, as well as members of the public seeking access to those documents.
What happened
In Kate Spade LLC v. Vinci Brands LLC, interested parties had temporarily sealed certain documents but had not shown why the documents should remain sealed permanently.
The court gave interested parties until March 31, 2025, to file requests explaining why the documents at ECF No. 408 should remain sealed; otherwise, those documents will be made public. The court also ordered the unsealing of documents at ECF Nos. 304, 305, and 382 because no permanent-sealing request was filed. Motions concerning ECF Nos. 424 and 426 were terminated because the court had already granted Vinci Brands LLC’s later request to seal the related documents.
Judge Valerie Figueredo ordered the Clerk of Court to carry out these actions and terminated the listed motions. The order did not decide the parties’ underlying dispute.

Background
The court addressed several motions concerning the temporary and permanent sealing of documents. A provisional seal temporarily restricts public access while the parties seek a decision on whether the documents should remain sealed.
ECF No. 408
The court stated that interested parties had not yet shown why the documents provisionally sealed at ECF No. 408 should be permanently sealed. The court directed anyone seeking permanent sealing to file a letter motion supported by the required showing under Lugosch v. Pyramid Co. of Onondaga by March 31, 2025. If no showing is made, the documents will be unsealed. The Clerk of Court was directed to terminate the motion at ECF No. 408.
ECF Nos. 303, 381, 304, 305, and 382
The court had previously directed interested parties to seek permanent sealing of the provisionally sealed documents at ECF Nos. 304, 305, and 382 by November 1, 2024. Because no showing was made, the court directed the Clerk of Court to unseal those documents and terminate the motions at ECF Nos. 303 and 381.
ECF Nos. 424 and 426
Letter motions seeking provisional seals were filed at ECF Nos. 424 and 426. Vinci later moved to permanently seal the related documents, and the court granted that motion at ECF No. 443 on December 10, 2024. Because of that ruling, the court deemed the motions at ECF Nos. 424 and 426 resolved and directed the Clerk of Court to terminate them.
Disposition
The court entered the sealing and unsealing directions described above. This order concerned document access and did not resolve the underlying claims between Kate Spade LLC and Vinci Brands LLC.
