Precision Medicine Group, LLC, et al. v. Blue Matter, LLC, et al.

Background

Precision alleges that Blue Matter misappropriated Precision’s trade secrets and other confidential information to establish a competing pharmaceutical Market Access consulting business. Precision sought discovery concerning Blue Matter’s Market Access consulting services for Precision clients, revenue from those services, and documents concerning any continued use of Precision’s trade secrets.

Precision originally made this discovery request in July 2023, while the parties’ summary-judgment motions were pending. During a telephone conference, Blue Matter argued that the request was premature because the trade-secret claims might be dismissed. Magistrate Judge Sarah L. Cave denied the request without prejudice to renewal after the summary-judgment decision and directed Blue Matter to preserve the relevant documents and information. She also denied without prejudice Precision’s request that Blue Matter conduct a search for documents concerning continued use of the trade secrets.

Developments After Summary Judgment

On September 22, 2025, Judge Paul Gardephe denied Blue Matter’s motion for summary judgment as to Precision’s trade-secret and unfair-competition claims. He granted Blue Matter’s motion as to Precision’s tortious-interference and aiding-and-abetting claims. The court also denied Precision’s partial summary-judgment motion in its entirety. The trade-secret and unfair-competition claims were scheduled for trial beginning November 10, 2025.

After that ruling, Precision renewed its discovery request. Precision stated that Blue Matter had not supplemented its discovery responses since February 18, 2021, and that Blue Matter had declined to provide the requested materials voluntarily. Precision argued that updated information was needed to calculate potential damages, including any alleged unjust enrichment from the use of Precision’s trade secrets.

Order

The October 1, 2025 order states that the court received Precision’s motion to compel and Blue Matter’s response. It scheduled a telephone conference for October 16, 2025, at 4:00 p.m. Eastern Time, to discuss the motion. The order did not state that the renewed motion to compel was granted or denied. The order was signed by Magistrate Judge Sarah L. Cave, while the summary-judgment decision discussed in the filing was issued by Judge Paul Gardephe.
