What happened
In Carson v. Western Express, Inc., Jermaine Carson sought damages under New York Insurance Law after a truck collision in Pennsylvania involving Timothy Tucker and a truck owned by Western Express, Inc.
The defendants argued that the federal court in New York could not exercise authority over either of them. Carson argued that Western Express’s appointment of an agent to receive legal papers in New York created that authority.

Background
Jermaine Carson sued Western Express, Inc. and Timothy Tucker for damages under New York Insurance Law. The lawsuit arose from a December 28, 2017 collision in Pennsylvania. The opinion states that Tucker, while working for Western Express and driving a Western Express truck, allegedly rear-ended Carson’s truck. Carson is domiciled in New York, Tucker is domiciled in Virginia, and Western Express is incorporated and headquartered in Tennessee. The opinion also states that Western Express does business across the United States and had appointed an agent to receive legal papers in New York under the Federal Motor Carrier Act.
The defendants removed the case from New York Supreme Court to federal court. They raised lack of personal jurisdiction as a defense and moved for summary judgment. Summary judgment is a decision without a trial when the undisputed facts show that a party is entitled to judgment under the law.
Personal Jurisdiction Analysis
The court explained that specific personal jurisdiction did not apply because the collision occurred in Pennsylvania and Carson alleged no injuries connected to New York. The remaining issue was general personal jurisdiction, which permits a court to hear claims unrelated to the defendant’s contacts with the forum only when those contacts are so substantial that the defendant is essentially at home there.
Carson argued that Western Express consented to general personal jurisdiction in New York by designating an agent for service of process there. The court rejected that argument, finding persuasive a post-Daimler decision from the same district holding that appointing such an agent does not, by itself, create general personal jurisdiction in New York.
The court also found no other basis for jurisdiction. Western Express was incorporated and headquartered in Tennessee, had terminals in seven states but none in New York, and had no offices or bank accounts in New York. The court found that Western Express was not essentially at home in New York. As to Tucker, the court noted that he was domiciled in Virginia and had little to no connection to New York. Carson did not present evidence or allegations sufficient to establish jurisdiction over either defendant.
Disposition
The court GRANTED Defendants’ motion for summary judgment. The Clerk was directed to terminate the motion and close the case. Judge Edgardo Ramos signed the opinion and order.
