Background
Red Fort Capital, Inc. brought an action against defendants whom it alleged failed to repay a loan according to the parties’ agreement. Magistrate Judge Robert W. Lehrburger issued a Report and Recommendation on August 18, 2020. He recommended dismissing the Guardhouse entities’ and Iacono’s defenses and counterclaims and entering judgment against them. The recommendation referred to a show-cause hearing at which the magistrate judge described several alleged violations of discovery orders and obligations, including issues involving documents, interrogatories, attendance at a court-ordered deposition, Iacono’s failure to appear at a required proceeding, and statements in her written submission to the court that the magistrate judge viewed as false.
Failure to Object and Standard of Review
The recommendation gave the parties 14 days to file written objections and warned that failing to object would waive the right to object and prevent appellate review. More than a month passed, and no objections or requests for an extension were filed. The district court therefore stated that the defendants waived their right to object or obtain further judicial review of the magistrate judge’s decision.
Because the recommendation was unobjected to after clear notice, the court reviewed the record for clear error rather than conducting a fresh review of the magistrate judge’s factual and legal conclusions. Judge P. Kevin Castel found no clear error and stated that the recommendation was well-reasoned, well-founded, and grounded in law.
Ruling
The court adopted the Report and Recommendation in its entirety. It dismissed the defenses and counterclaims of the Guardhouse entities and Surya Iacono, entered judgment against them, and directed the Clerk to enter judgment for Red Fort as to those defendants.
