Plaintiff did not meet the first deadline and also failed to respond by a later deadline. The Court gave Plaintiff until February 16, 2021, to submit a letter explaining how it would proceed against Kingdom Resources.
Judge Ronnie Abrams warned that the Court would dismiss Kingdom Resources, LLC from the case if Plaintiff did not comply. The February 9 order did not itself dismiss that defendant.

Background
On January 13, 2021, the Court ordered Plaintiff to inform it how Plaintiff intended to proceed against Defendant Kingdom Resources, LLC. The order followed Kingdom Materials Holdings LLC’s representation that it and Kingdom Resources were not affiliated. Plaintiff was directed to respond by January 20, 2021, but did not timely comply.
The Court then issued a second order requiring Plaintiff to reply by February 5, 2021, and warned that failure to comply could result in sanctions.
Order
The Court ordered Plaintiff to submit a letter by February 16, 2021, advising how it intended to proceed against Kingdom Resources, LLC. The Court stated that if Plaintiff failed to comply by that date, it would dismiss Kingdom Resources, LLC from the action. The opinion does not state that the dismissal had already occurred.
