Background
Defendants Teligent Inc. and Grenfell-Gardner asked the court for permission to file two expert reports as nonpublic documents in connection with their opposition to the plaintiff’s motion for class certification. The reports were identified as the expert report of Carl Seiden and the expert report of Maureen Chakraborty, Ph.D., and were to be filed as Exhibits C and D to Douglas Baumstein’s declaration.
The defendants said the reports described confidential Teligent business information, including product research and development and information from abbreviated new drug applications. They stated that they did not object to the plaintiff’s access to the reports and sought only to restrict access by the general public.
Ruling
The court granted the defendants’ request to file Exhibits C and D under seal. Judge Victor Marrero’s order did not state that the plaintiff would be denied access to those documents.
