Background

An administrative decision, identified as SRO Decision 21-163, established N.R.’s placement at iBrain and legally required the New York City Department of Education to fund N.R.’s education there for the 2020–2021 school year.
The parties did not dispute that the Department ultimately had to pay the costs. Their dispute concerned the payment method: the plaintiffs sought direct payment to iBrain, while the Department described the issue as reimbursement to N.R.’s parents after they proved that they had paid. The 2020–2021 school year had ended. The plaintiffs acknowledged that N.R. received the education and related services required by the placement order, but said they had not received the full relief they sought because tuition repayment remained unresolved. N.R. died in October 2021.
