Bettis v. Metropolitan Correction Center

Background

Zubearu Bettis was incarcerated at the Westchester County Department of Corrections and was transferred to USP Canaan Correctional Facility on or about May 24, 2022. On July 11, 2022, he informed the court that he had not been allowed to bring his legal paperwork with him during the transfer. The order states that some of the paperwork related to Bettis’s prosecution of this case.

Court’s Action

The court requested that the Commissioner or other official in charge of the Westchester County Department of Corrections secure Bettis’s legal paperwork in the facility’s possession and mail it to Bettis at USP Canaan. The court cautioned that failure to provide legal paperwork could result in a constitutional violation if the deprivation actively hindered Bettis’s efforts to pursue his legal claims. The order cited a prior decision for that proposition but did not decide whether a constitutional violation had occurred here.

Because the paperwork might contain information protected by the attorney-client privilege or work-product doctrine, the court directed that the envelope containing it be marked “LEGAL MAIL — CONFIDENTIAL.” The Clerk of Court was requested to mail copies of the order to the Westchester County corrections commissioner, an assistant chief deputy county attorney, and Bettis.
