Background
Magistrate Judge Katharine Parker issued a Report and Recommendation on July 13, 2022, recommending that the Court deny Defendants’ motion for sanctions under Rule 11 of the Federal Rules of Civil Procedure. The parties were given 14 days to object.
Defendants filed a single objection on July 27, 2022. On October 11, 2022, Defendants filed a letter withdrawing that objection. Plaintiff consented to the withdrawal.
Court’s Analysis
The Court explained that a district judge may accept, reject, or modify a magistrate judge’s Report and Recommendation. When a party makes a timely objection, the district judge reviews the challenged portion independently. When there is no objection, the district judge reviews the recommendation for clear error, meaning an obvious mistake.
Because Defendants withdrew their objection, the Court reviewed the Report and Recommendation for clear error. The Court found none.
Ruling
Judge Liman adopted the Report and Recommendation in its entirety and denied Defendants’ motion for sanctions.
