What happened
In The Sanborn Library LLC v. ERIS Information Inc., The Sanborn Library and Environmental Data Resources, together called EDR, were scheduled to oppose ERIS’s motion for summary judgment and file a related cross-motion.
EDR asked to file its opposition materials, except exhibits, provisionally under seal; provide the exhibits and other materials on flash or hard drives instead of through the court’s electronic filing system; and later file a formal request to seal confidential information and publicly file any remaining materials. EDR said the materials might contain information protected by the parties’ protective order and that the large files could create technical and logistical problems. ERIS consented.
Judge Wang granted the application. The order therefore allowed EDR to use the requested provisional sealing and alternate submission process, with the formal sealing motion and public filing of remaining materials due by July 10, 2023.

Background
The Sanborn Library LLC and Environmental Data Resources, LLC, identified collectively as “EDR,” were represented as plaintiff and counterclaim-defendants. EDR was scheduled to file its combined opposition to ERIS Information Inc.’s motion for summary judgment and a related cross-motion on June 8, 2023.
Request
EDR asked for permission to:
- file its opposition materials, excluding exhibits, provisionally under seal through the court’s electronic filing system; - provide the court with flash or hard drives containing the opposition materials, including exhibits, instead of filing the exhibits through that system; and - file a formal motion to seal confidential information and publicly file any remaining materials by July 10, 2023.
EDR stated that some opposition materials would contain information designated “Confidential” or “Highly Confidential—Outside Counsel’s Eyes Only” under the amended protective order. It also cited the volume and file sizes of the materials, along with the risk of technical and logistical problems, as reasons for requesting this procedure. EDR said the process would allow the parties to confer about which documents needed sealing and to provide explanations to the court. Counsel for ERIS consented.
Ruling
Judge Ona T. Wang granted the application. The opinion does not provide a separate explanation beyond the order granting the requested procedure. It allowed the provisional sealing, alternate delivery of the materials, and later formal sealing and public-filing process described in EDR’s request.
