Background
Mattel asked for an extension of time to respond to the court’s October 12, 2023 order. That earlier order directed the parties to provide additional briefing about the applicability and possible effect of Abitron Austria v. Hetronic International, Inc., 600 U.S. 412 (2023), on the remaining issues in the case.
Mattel stated that its attorneys had several conflicting deadlines near the original November 2 response deadline. Mattel said this was its first request for an extension. It also said that it had contacted the defendants identified as the “Wang Defendants”—AnimeFun Store, Bingo 1993, Bingoes Hot Toy Factory, Miliy Store, and Q374428329—and received no objections.
Ruling
The court granted Mattel’s request for an extension. Mattel’s deadline to respond to the October 12 order was extended to November 16, 2023. The Wang Defendants’ deadline to respond was extended to December 7, 2023, and Mattel’s deadline to reply was extended to December 21, 2023.
This order addressed scheduling only. It did not resolve the effect of the Supreme Court decision or decide the remaining underlying issues.
