Background
Sanmina Corporation submitted an application seeking permission to file two exhibits under seal in support of its reply concerning a motion about trial evidence. The exhibits were Exhibit 6, a quarterly business review, and Exhibit 7, Dialight’s estimated build plans. Dialight PLC had designated Exhibit 6 as confidential under the protective order governing discovery in the action. Sanmina stated that both exhibits contained information, including financial information, that would be of significant interest to competitors of Sanmina and Dialight.
The application concerned two related Southern District of New York cases: Sanmina Corporation v. Dialight plc, No. 19 Civ. 11710, and Dialight plc v. Sanmina Corporation, No. 19 Civ. 11712.
Ruling
The court granted the application. It directed the Clerk of Court to maintain docket entry 219 in Case No. 19 Civ. 11710 and docket entry 188 in Case No. 19 Civ. 11712 under seal, viewable only by the court and the parties. Effect
