Judge J. Paul Oetken lifted the stay and ordered the case to proceed; the Clerk of Court was directed to lift the stay.

Background
The case had been stayed, or paused, pending an order from the Second Circuit on the plaintiffs’ petition under Rule 23(f). That rule allows a party to ask an appeals court to review a class-certification decision before the case is otherwise finished.
On September 12, 2024, the Second Circuit stated that the district court should decide the summary-judgment motion first. It held the plaintiffs’ petition in abeyance, meaning it temporarily deferred action on the petition, while waiting for this Court’s decision on summary judgment.
Ruling
The Court lifted the stay issued on July 15, 2024, and ordered that the case proceed as usual. The Clerk of Court was directed to lift the stay.
