Gallegos v. Bruce

Background

Benjamin Robert Gallegos filed this civil-rights action under 42 U.S.C. § 1983. The opinion states that he was proceeding without a lawyer and without paying filing fees. The case was filed in the Eastern District of California and was later transferred within that district based on allegations in the first amended complaint.

Ruling

The court ordered that Gallegos’s claims arising at Salinas Valley State Prison be severed from the existing action and transferred to the United States District Court for the Northern District of California, where they would proceed as a separate civil action. The clerk was ordered to send the Northern District of California a copy of the order and the first amended complaint filed on December 19, 2023. The order did not state that the Salinas Valley claims were dismissed.
