Background
Ricky Mott brought this civil action without a lawyer. He submitted a complaint but did not pay the required filing and administrative fees, totaling $405, and did not submit a signed application to proceed without prepaying those fees. He also did not provide a mailing address for receiving court documents.
Court’s directions
The court ordered Mott, within 30 days of the order, to do one of two things: pay $405 in fees or submit an application to proceed without prepaying fees, commonly called an IFP application. If he submits the application, it must identify docket number 25-CV-5451 (LTS). The court also ordered him to provide, within 30 days, a mailing address where he can receive court documents.
The court noted that Mott had used an address in other cases, but mail sent there had been returned as undeliverable. The court therefore directed him to provide a current mailing address. No summons will issue at this time.
Disposition
Judge Laura Taylor Swain ordered that the case be processed under the Clerk’s Office procedures if Mott complies. If he does not comply within the allowed time, the action will be dismissed. The court also certified that an appeal from this order would not be taken in good faith and denied permission to proceed without prepaying fees for purposes of an appeal. The order did not address the merits of Mott’s claims.
