In Leonichev v. Knoll, Judge Seibel ordered three new penalties totaling $250 after repeated filings violated an earlier order and warned the case could be dismissed.
Alexey Leonichev must pay $50, $100, and $100 to the Clerk of Court by September 24, 2025, in addition to earlier payments of $50 to the Clerk and $100 to Defendants’ counsel due September 17, 2025. The order also warns that continued violations could lead to dismissal of his case.
What happened
In Alexey Leonichev v. Alexander Robert Knoll, et al., the court said Leonichev violated an earlier order barring further submissions about several previously raised issues, including jury trial, judicial assignments, defaults, counsel authority, docket orders, and accusations of criminal conduct.
The court treated filings docketed as ECF Nos. 58, 59, and 60 as one submission and ordered Leonichev to pay $50 to the Clerk of Court. It ordered two additional $100 penalties for separate filings at ECF Nos. 61 and 62. All three payments are due September 24, 2025. The court also reminded him of earlier payments due September 17, 2025.
Judge Cathy Seibel warned that continued violations involving the same issues could lead to dismissal of the case, but this order did not dismiss the case.
The detailed version
- Leonichev v. Alexander Robert Knoll · No. 7:25-cv-04959
- Cathy Seibel
- Sept. 10, 2025
Background
On July 31, 2025, the court ordered Plaintiff Alexey Leonichev not to make further submissions about issues raised in his earlier filings. The listed issues included a jury trial, the assignment of Judge Seibel and the designation of Magistrate Judge Krause, certificates of default, the law office of Manson & McCarthy, Frank Spano’s authority to appear as counsel, the authenticity of docketed orders, and accusations of criminal conduct.
On September 3, 2025, the court sanctioned Leonichev for violating that order. It ordered him to pay $50 to the Clerk of Court and warned that further violations could result in harsher sanctions. The court also required a $100 payment to Defendants’ counsel.
Current Order
The court found that Leonichev again violated the July 31 order through filings at ECF Nos. 58, 59, 60, 61, and 62. It treated ECF Nos. 58, 59, and 60 as one submission because they were sent together in one email. Although that submission was made before the September 3 warning was docketed, the court found that it still violated the July 31 order.
The court ordered Leonichev to pay a $50 monetary penalty to the Clerk of Court for the ECF Nos. 58–60 violation by September 24, 2025. It ordered two additional $100 monetary penalties to the Clerk for the separate violations involving ECF Nos. 61 and 62, also due September 24, 2025.
The court reminded Leonichev that the payments ordered on September 3—$50 to the Clerk and $100 to Defendants’ counsel—were due September 17, 2025. It warned that continuing to raise the same issues in violation of the court’s order could result in dismissal under Federal Rule of Civil Procedure 41(b), which permits involuntary dismissal when a plaintiff fails to comply with a court order.
Disposition
The court imposed three new monetary penalties totaling $250 and issued a warning that the case may be dismissed if Leonichev continues violating the order. The opinion does not dismiss the case. Judge Cathy Seibel signed the order on September 10, 2025.
