Kern v. Pelican Bay State Prison

Background

James Curtis Kern, a state prisoner proceeding without a lawyer, filed a civil-rights action under 42 U.S.C. § 1983. He also applied to proceed without paying the filing fee. The complaint alleged that state officials at Pelican Bay State Prison knowingly placed him in a defective vehicle and transported him to San Joaquin General Hospital, causing him to be injured during transport.
