Background
On April 1, 2020, the Boy Scouts of America notified the district court that the Bankruptcy Court for the District of Delaware had entered an order granting a preliminary injunction and staying this action. The stay initially lasted through May 18, 2020, and the bankruptcy court later extended it several times.
In July 2021, the Boy Scouts notified the district court that prosecution of all claims in the action was stayed through the first hearing after the bankruptcy court decided whether to confirm or deny confirmation of the Boy Scouts’ reorganization plan. The district court asked the parties to provide a status update after that hearing. A later notice in December 2021 provided the same information, and the court again requested a status update.
Court’s Action
The bankruptcy court issued an opinion concerning confirmation of the Boy Scouts’ reorganization plan on July 29, 2022. The district court stated that it had not received a status update and therefore assumed that the claims in this action had been resolved. The court stated that the case would be closed unless a request to keep it open was submitted by February 17, 2026.
This order did not rule on the merits of Wane X’s claims or state that any claim was dismissed. It addressed the case’s status after the bankruptcy-related stay and set a deadline for requesting that the case remain open.
