Background

Jurisdiction and Analysis

The court relied on the federal removal statute, which requires a case to be removed to the federal district and division covering the state court where the action is pending. The court concluded that this case should have been removed, if at all, to the Eastern District of New York. Because the removal was to the wrong federal district, the notice of removal was ineffective and the court lacked authority to hear the case.

The court explained that when a federal court lacks authority over a removed case, the usual remedy is to send it back to the state court from which it was removed. Although the state court was outside the California federal court's district, the court determined that sending the case back to the Supreme Court of New York, Kings County, was appropriate. Dismissing the action instead would have penalized Newco Capital Group LLC for Fitzgerald's removal error.

Disposition

The court remanded the case to the Supreme Court of New York, Kings County. It did not decide the parties' underlying claims. Judge Jon S. Tigar signed the order on April 13, 2022.
