Judge Nelson ordered the stay extended until the Waseca County District Court issues its decision. The federal court will then reconsider whether to continue the stay, consider Steven Roehrs’s possible request to amend his complaint, or proceed with the case.

Background
Steven Roehrs filed this federal case concerning control and management of family farmland held by the Ronald E. Roehrs Trust. He alleges that he is the rightful successor trustee and that misconduct by Marvel E. Roehrs and several defendants wrongfully deprived him of that role. His requested relief includes declarations about who could serve as trustee, appointment as trustee, disgorgement of funds, access to trust records, an accounting, and litigation costs and attorney’s fees.
A related case in Waseca County District Court concerned the administration of the same trust. That court confirmed Janet Tharp’s appointment as trustee and ordered entry of judgment. Michael Roehrs appealed. On April 30, 2024, the Minnesota Court of Appeals remanded the state case because it could not discern the bases for the district court’s rulings, directing the district court to make findings and clarify its order. The appellate court left it to the district court to decide whether to reopen the record.
Prior Federal Ruling and Current Order
In January 2024, this Court denied the defendants’ motion to dismiss and granted their motion to stay the federal proceedings until the Minnesota Court of Appeals decided the state appeal. After the appellate decision, the parties submitted a status update. Steven also informed the Court that, if the stay were lifted, he would seek permission to amend his complaint, add facts and defendants, and add a declaratory-judgment claim.
Ruling
The Court extended the stay of proceedings. It concluded that continuing the temporary stay served judicial economy and justice because the Waseca County District Court was expected to make findings and clarify its order. The stay will remain in place until that state court issues its decision. Afterward, the federal court will reevaluate whether to extend the stay, consider Steven’s possible motion for permission to amend the complaint, or otherwise proceed. This order did not decide the underlying trust dispute.
Disposition
The stay was EXTENDED pursuant to the Court’s earlier order.
