Background
Cedric Reid, currently incarcerated at Green Meadow Correctional Facility, filed this action without a lawyer under 42 U.S.C. § 1983. The court had previously granted Reid permission to proceed without paying filing fees. Because he received that permission, the court stated that he could rely on the court and the U.S. Marshals Service to serve the defendants.
The court had ordered service on Securus Technologies at 14651 Dallas Parkway, Dallas, Texas 75254. A process receipt filed by the Marshals Service on April 1, 2021, reported that service was not completed because Securus could not be located at that address. The court identified an alternate service address: 4000 International Parkway, Carrollton, Texas 75007.
Ruling
Judge Katherine Polk Failla instructed the Clerk of Court to complete the USM-285 service form using the alternate address and to provide the U.S. Marshals Service with all documents needed to serve Securus Technologies. The judge also directed the Clerk to mail a copy of the order to Reid’s address of record. The order addressed service only and did not decide the merits of Reid’s claims.
