Lisa Buon, Lisamarie Spindler, Roberto Padilla, and the Newburgh Enlarged City School District; the order extended the time for service on Spindler and Padilla and reopened the case.
What happened
Lisa Buon sued Lisamarie Spindler, Roberto Padilla, and the Newburgh Enlarged City School District, alleging violations of federal employment-discrimination law and the Fourteenth Amendment. The district court had previously dismissed her amended complaint, and the Court of Appeals later sent part of the case back for further consideration.
The Court of Appeals instructed the district court to decide whether Buon should receive more time to properly serve Spindler and Padilla. The district court granted Buon until June 1, 2023, to complete service. The parties then had until June 22, 2023, to answer or seek permission to file a response to the remaining claims, and the clerk was directed to reopen the case.
Judge Nelson S. Roman issued the order in Buon v. Spindler. The court granted the 45-day extension and directed that the case be reopened.

Background
Lisa Buon sued Lisamarie Spindler, Roberto Padilla, and the Newburgh Enlarged City School District. Her amended complaint alleged violations of Title VII of the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment, asserted through 42 U.S.C. § 1983.
The district court had granted the defendants’ motion to dismiss the amended complaint on March 18, 2021. Buon appealed. The Court of Appeals vacated part of that decision and affirmed part of it. It remanded the case for the district court to decide whether Buon should receive an extension of time to properly serve Spindler and Padilla.
Ruling
The district court granted Buon 45 days, until June 1, 2023, to properly serve Spindler and Padilla. The court also set June 22, 2023, as the deadline for the parties to answer or seek permission to file a response to the remaining claims in the amended complaint. The clerk was directed to reopen the case.
